Why was the Tier 1 Investor Visa Extension UK Closed?
The Tier 1 Investor route was closed to new applicants from the 17th of February 2022 by the Home Office. The decision followed increasing concerns surrounding potential abuse of the route, specifically in relation to unlawful finance and national security risks.
The route was initially opened to allow high-net-worth individuals to obtain residency in the UK, by investing at least £2 million in qualifying UK investments. These were typically governments bonds, share capital or loan capital in UK companies. While the route attracted significant foreign investment, major concerns grew that the visa would be used by individuals seeking to move questionable funds to the UK.
Over some time, the Home Office tightened the rules surrounding this visa, including requiring stronger due diligence checks and restrictions on qualifying investments. For example, in 2019, government bonds were no longer recognised as a qualifying investment. Despite already creating changes to minimise risk within the route, the Home Office that the route continued to present such risks relating to financial transparency and economic crime.
As part of the wider strategy to combat these risks, the government decided to close the route entirely to new applicants from February 2022. However, since this date, those who already held Tier 1 visas prior February 2022 may still be able to apply for extensions or settlement under the existing rules, should they still meet the relevant requirements.
Who is eligible to apply for a Tier 1 Investor Visa UK?
Following the closure of the Tier 1 Investor Visa route on 17th of February 2022, the UK Government introduced transitional arrangements for individuals who already had permission under this route. However, these arrangements were gradually phased out, and the ability to now extend under the Tier 1 Investor route has largely come to an end in February 2026.
Historically, individuals who already held leave as a Tier 1 Investor were able to apply for an extension if their visa was due to expire, and if they had not yet reached the qualifying residence period needed for ILR. These Applicants were required to continue meeting the investment and immigration requirements under the route.
After the 17th of February 2026, those holding a visa under the route were not longer able to extend their visas. Those who already held longer leave or were able to extend prior to the above deadline may still be able to apply for indefinite leave to remain, provided they sill meet the requirements and submit before any relevant deadlines.
It is important that existing tier 1 visa holders are aware of any deadlines that may apply to them, as a failure to meet these may result in immigration issues, should they wish to remain in the UK.

What should I do if my Tier 1 Investor Visa Extension UK is Expiring?

In most cases, investors will need to apply for either an extension, or indefinite leave to remain, depending on how long they have been in the UK and whether they meet the settlement requirements.

The required residence period ultimately depends on the amount the person has invested, for example, individuals who invested larger amounts during the course of their visa may qualify for accelerated settlement.
Is there a pathway to ILR or Citizenship from the Tier 1 Investor Visa UK?
Yes, the Tier 1 Investor Visa offers a pathway to indefinite leave to remain and eventually British citizenship, provided the applicant meets the relevant requirements for these routes.
The standard route to settlement generally requires investors to spend five continuous years in the UK, whilst still maintaining their qualifying investment. However, the route previously offered accelerated settlement options for individuals who invested higher amounts during their visa.
For example, if an individual invested £5 million during the course of their visa, their qualifying period for settlement could drop to just 3 years. Larger amounts of investment could lower this qualifying period even further.
In addition to meeting the investment and residence requirements, applicants must also satisfy the general criteria for settlement. This includes passing the Life in the UK test, as well as meeting any English language requirements.
After obtaining indefinite leave to remain, individuals may become eligible to apply for British citizenship. This is usually available to applicants 1 year from the date their ILR was granted, but may be available sooner in specific circumstances. To apply for British Citizenship, applicants must ensure they meet any required residence and good character requirements.
Ultimately, although the route is now closed to both new applicants and those seeking extensions, those who already hold the visa may still progress towards settlement and citizenship under the transitional rules.
